Navigating the Government's Proposed Rise in Family Court Fees: What You Need to Know

As the proposed increase in family court fees looms, individuals navigating the legal intricacies of divorce, child arrangements, and financial proceedings are poised to face new financial considerations. At Pharaoh Law, we recognise the potential stress and additional cost concerns that this increase can bring, but whilst the court fees are being raised, our rates and fees will not be rising to match this. Transparency is integral for us and we want to ensure that all who may be considering legal action within the family court feel informed and in safe hands throughout the whole process.

But why are court fees increasing?

The family court system serves as a cornerstone of justice, ensuring equitable resolution for families across England and Wales. However, sustaining this vital service has recently presented a challenge. Inflationary pressures have exacerbated operating costs, calling for a careful balance between affordability and ensuring enough funding. The proposed 10% fee increase seeks to alleviate strains on the system while preserving accessibility for those in need.

Come April 2024, the court fee cost of initiating divorce proceedings is to rise from £593 to £652. For those pursuing Child Arrangements Orders, the current application fee of £232 may escalate to £255 under the proposed fee revisions. It's important to note that additional expenses, such as mediation costs, may also factor into the equation, although the government scheme offering the first £500 mediation cover is expected to continue. Securing approval for a consent order, which formalizes financial agreements between ex-partners, typically involves a £53 court fee. This fee structure may see an uptick to £58 in line with the proposed adjustments. Applying for a financial remedy order within divorce proceedings currently incurs a fee of £275, which could climb to £303 post-implementation. Individuals embarking on multiple court proceedings within the same divorce case should be prepared for separate fee assessments.

In the face of evolving fee structures and legal complexities, the guidance of experienced family law solicitors proves invaluable. By offering clarity on fee breakdowns and advocating for amicable resolutions whenever feasible, we can help you to navigate family law proceedings with confidence. Contact us today to talk our family law solicitor and feel informed, in control and empowered.

  • Good Divorce Week - 28 November to 2 December 2022

    Good Divorce Week

We are supporting Resolution - first for family law  and this year's GoodDivorceWeek (28 Nov - 2 Dec) highlighting the crisis in the courts and raising awareness of how families can resolve their disputes away from court.

A ‘good’ divorce is one in which any financial and/or child related matters are fairy resolved between parties, with the hope of remaining amicable in the future.

Our consultant solicitor, Deborah Schmieder is a family law specialist and member of Resolution and can provide empathetic and professional legal advice during the breakdown of a relationship recognising that this is a stressful and emotional time for all parties and families.

Engaging with a family lawyer early can save time, money and emotional turmoil in the future.

    Alternatives to Court include:

Mediation – A mediator will meet with you and your partner together and will identify those issues you can’t agree on and help you to try and reach agreement.

Mediators are neutral and will not take sides, so they cannot give advice to either of you. They will usually recommend that you obtain legal advice alongside the mediation process and will guide you as to when this should happen

Collaborative Practice – Under the collaborative process, each person appoints their own collaboratively trained lawyer and you and your respective lawyers all meet together to work things out face to face. Both of you will have your lawyer by your side throughout the process and so you will have their support and legal advice as you go.

Arbitration – In family arbitration you and your partner appoint an arbitrator, who will make a decision that will be final and binding between the parties, on any financial and property disputes or some child-related issues arising from family relationships

Our aim is to offer our clients a "good divorce experience", whatever time of the year.

Should you require any further information, please feel free to get in touch.

We are a small friendly practice that has, throughout lockdown and beyond, continued to provide an exceptional standard of customer service.  We wish to maintain this standard by offering face to face meetings where required.  Clearly, should our staff succumb to Covid-19 it will have a catastrophic effect upon all including the service that we provide to our clients.

We therefore reserve the right to withdraw this "face to face" Consulting Room service without notice should we believe that there is a heightened risk of infection via Covid-19 to our clients, visitors, colleagues or families.

    Remote "Face to face" meetings

During lock-down there has been an unprecedented rise in the use of these platforms to connect and keep in touch with families, friends and work colleagues and so you may well have a preference for a particular platform.  If so, then please let us know.  If there is a method of communication which we have not mentioned that you wish us to use then let us know and we should be able to accommodate your request.

We can also accommodate meetings with multiple parties too, as a group "remote" meeting.
